CMLA has a great FAQ that you can download concerning the process. In my opinion, the state government does not posses the competence to properly run a program like this. The most current indication of this is CMLA's recommendation to get the process underway by September 1st. Anyway, the time to act is now. Not only does it set up a giant bureaucracy, they want consumers to pay for it. Placing a fee on every closing (which will be passed on the consumer one way or another) to fund prosecution of the law breakers makes no sense, isn't that what our tax dollars are for? It was a surprise to me that the were endorsing the passage of Colorado's Referenda C&amp;D. For those no familiar with C&amp;D, they basically suspend parts of TABOR, the Colorado taxpayer's rights bill. The end result is a tax increase, even though the proponents claim otherwise. &lt;a href="http://www.defeatc.com/files/refcfaq.html"&gt;You can get more info here&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;CAMB's reasoning for the endorsement is based on their desire to institute licensing in Colorado. You see, they want the  licensing to be funded through government. The government does not have the budget to do so. The solution as they see it, is to increase taxes for every Colorado tax payer in order to fund their plan. &lt;br /&gt;&lt;br /&gt;I disagree with CAMB on both counts. Licensing is nothing more than a feel good measure and funding on the backs of taxpayers just makes it that much worse. This funding option can provide greater flexibility when closing loans and allows consumers, real estate agents and other parties to a loan transaction to receive funds at the closing table.&lt;br /&gt;&lt;br /&gt;Over the past eighteen months, the Colorado Division of Insurance ("DOI") has worked with the Land Title Association of Colorado ("LTAC"), the CMLA and other interested parties to amend the Tri-Party Agreement ("TPA") to better accommodate the interests of consumers, title companies, lenders and warehouse line providers.&lt;br /&gt;&lt;br /&gt;DOI has published a new TPA as part of a 23-Page regulatory bulletin available at their web site.  Lenders, title companies and warehouse line providers who have interest in the TPA should consult Pages 14 - 16 of DOI bulletin # 3-5-1 for information about the TPA and the "Good Funds" Statute.&lt;br /&gt;&lt;br /&gt;It is also important for all lenders, title companies and warehouse line providers who utilize TPAs and checks to close loans to begin the process of converting to the newly amended TPA as soon as possible.
